These Terms and Conditions ("Terms") govern the sale of goods and services through the website www.branddash.co.za ("Website"), operated by BrandDash (Pty) Ltd ("we", "us", or "our"). By placing an order, accessing the Website, or using our services, you agree to be bound by these Terms.

We are based in South Africa, and these Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the exclusive jurisdiction of the courts in Randburg/Gauteng.

Orders and Acceptance

All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order (in whole or part) for any reason, including unavailability of stock, pricing errors, or suspected fraud.

Prices are quoted in South African Rand (ZAR), inclusive of VAT where applicable, and exclude delivery/shipping costs unless stated otherwise.

Quotations are valid for 7 days unless otherwise specified. We may amend prices without notice due to currency fluctuations, supplier costs, or errors (E&OE – Errors and Omissions Excepted).

Orders are binding once we confirm acceptance (via email or order confirmation).

Payment

Payment must be made in full before dispatch/delivery unless credit terms have been approved in writing.

We accept EFT, credit/debit cards (via secure gateway), or other methods specified at checkout.

All payments are non-refundable except as provided in these Terms or required by law.

Delivery and Risk

Delivery times are estimates only. We are not liable for delays caused by couriers, force majeure, customs, or events beyond our control.

Risk of loss or damage passes to you upon delivery to the address provided, or on collection if you collect from us.

For delivered goods, you must inspect goods upon receipt and notify us in writing within 48 hours of any damage, shortages, or defects.

Delivery is to ground floor only unless otherwise agreed (additional charges may apply for stairs, lifts, etc.).

Returns, Refunds, and Cancellations

No cooling-off period applies for custom or personalised goods (e.g., branded items, printed products, or made-to-order items).

Standard returns may be accepted within 7 days of delivery for unused, unopened goods in original packaging, at your cost (return shipping). Approval required in advance.

Refunds (if approved) exclude shipping fees and may be subject to a restocking fee (up to 20%).

Faulty/defective goods: Contact us within 7 days. We will repair, replace, or refund at our discretion, subject to inspection.

No refunds for change of mind on custom orders, digital downloads, or consumables.

Warranty and Liability

Goods carry the manufacturer's warranty (if any) as stated at purchase. We provide no additional warranties beyond those required by the Consumer Protection Act 68 of 2008 (CPA).

Warranty excludes misuse, improper installation, alterations, normal wear and tear, or damage from external causes (e.g., power surges, improper storage).

Our liability is limited to the value of the goods purchased. We are not liable for indirect, consequential, or special damages (e.g., loss of profits, business interruption).

Nothing in these Terms limits your rights under the CPA where applicable (e.g., for defective goods).

Intellectual Property and Branding

All designs, artwork, or files you provide remain your property, but you grant us a licence to use them for fulfilling your order.

We retain ownership of any custom designs or templates created by us unless otherwise agreed.

You warrant that any content you supply does not infringe third-party rights.

Privacy and POPIA

We process personal information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA). See our separate Privacy Policy for details.

Force Majeure

We are not liable for delays or failure to perform due to events beyond our reasonable control (e.g., strikes, natural disasters, load shedding, supply chain disruptions).

Amendments

We may update these Terms at any time. Changes will be posted on the Website. Continued use constitutes acceptance.
