These Terms and Conditions govern the sale of goods and services through www.branddash.co.za, operated by BrandDash (Pty) Ltd. By placing an order, accessing the website, or using our services, you agree to be bound by these terms.
BrandDash operates in South Africa, and these terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the exclusive jurisdiction of the courts in Randburg and Gauteng.
Orders and Acceptance
All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order, in whole or in part, for reasons including stock availability, pricing errors, or suspected fraud.
Prices are quoted in South African Rand (ZAR), inclusive of VAT where applicable, and exclude delivery or shipping costs unless stated otherwise.
Quotations are valid for 30 days unless otherwise specified in writing. Prices may change without notice due to supplier costs, currency fluctuations, or errors and omissions before acceptance.
Orders become binding once we confirm acceptance by email or order confirmation.
Payment
Payment must be made in full before dispatch or delivery unless credit terms have been approved in writing.
We accept EFT, credit or debit cards through secure gateways, and any other methods listed at checkout.
Payments are non-refundable except where these terms or applicable law require otherwise.
Delivery and Risk
Delivery times are estimates only. BrandDash is not liable for courier delays, force majeure, customs issues, or other events beyond our reasonable control.
Risk of loss or damage passes to you upon delivery to the address provided, or on collection if you collect directly from us.
You must inspect goods upon receipt and notify us in writing within 48 hours of any visible damage, shortages, or defects.
Delivery is to ground floor only unless otherwise agreed. Additional charges may apply for stairs, lifts, or special access requirements.
Returns, Refunds, and Cancellations
Standard returns may be accepted within 7 days of delivery for unused and unopened goods in original packaging, subject to prior approval and return shipping at your cost.
Approved refunds exclude shipping fees and may be subject to a restocking fee of up to 20%.
Faulty or defective goods should be reported within 7 days. We may repair, replace, or refund at our discretion after inspection.
No refunds apply for change-of-mind decisions on custom orders, digital downloads, or consumables.
Warranty and Liability
Goods carry the manufacturer warranty, if any, as stated at the time of purchase. BrandDash does not provide warranties beyond those required by the Consumer Protection Act 68 of 2008.
Warranty excludes misuse, improper installation, alterations, normal wear and tear, and damage from external causes.
Our liability is limited to the value of the goods purchased. We are not liable for indirect, consequential, or special damages such as loss of profit or business interruption.
Nothing in these terms limits your rights under the Consumer Protection Act where applicable.
Intellectual Property and Branding
All artwork, files, and designs supplied by you remain your property, but you grant BrandDash the licence necessary to use them for fulfilling your order.
BrandDash retains ownership of custom designs or templates created by us unless otherwise agreed in writing.
You warrant that all supplied content does not infringe third-party rights.
Client Zone and Tracking Links
BrandDash may provide a secure Client Zone link after you submit an enquiry. This link allows customer-safe access to enquiry progress, released quote information, artwork feedback, and related uploads.
Tracking links operate as bearer credentials. You are responsible for keeping the link private and notifying BrandDash if you believe it has been shared, compromised, or used without authority.
Tracking links may expire, be revoked, or be reissued by BrandDash. BrandDash reserves the right to restrict or remove Client Zone access where necessary for security, compliance, fraud prevention, or operational reasons.
Quote values and quote PDF files only become visible through the Client Zone once BrandDash releases them. Released quote PDFs may expire or be replaced after the stated quote validity period.
Artwork Uploads and Retention
Artwork supplied through the website, Client Zone, email, or other approved channels may be stored together with version history so BrandDash can review, reproduce, and manage revisions accurately.
New artwork submissions or revisions may be retained with earlier versions rather than overwriting prior files.
Active artwork records are generally retained for up to 6 months from the last order or reorder activity, after which they may move into archive storage for a further retention period, unless BrandDash must keep them longer for legal, accounting, operational, or dispute-resolution purposes.
You remain responsible for keeping your own master copies of artwork, source files, fonts, and linked assets.
Privacy and POPIA
We process personal information in compliance with the Protection of Personal Information Act 4 of 2013. Please refer to our Privacy Policy for further details.
Force Majeure
BrandDash is not liable for delays or failure to perform due to events beyond our reasonable control, including strikes, natural disasters, load shedding, or supply-chain disruption.
Amendments
We may update these terms from time to time. Updated terms will be posted on the website, and continued use of the site or our services constitutes acceptance of the revised terms.
